A 48-year-old man identified as Mallam Adamu Ibrahim Umaru has been remanded over alleged raping and impregnating his 15-year-old daughter.
Umaru’s imprisonment was ordered by the magistrate Court 1 in Calabar.
The respondent, a native of Bundugudu LGA of Zamfara State, residing at No. 27 Edem Odo Street, Calabar, the Cross River State capital,l, had canal knowledge of his daughter.
The suspect was remanded by Chief Magistrate Mercy Ene led court following a hearing on an expert motion filed by the Police Prosecutor, O. S Umoren.
Umoren had argued that the expert motion became necessary for the defendant to be remanded in prison custody until the completion of the investigation of the matter.
The Prosecutor said that the motion was under section 4 of the police act 2020 and also the Cross River State Administration of Criminal Justice Law 2016.
The motion was, however, opposed by the defendant’s counsel, Mohammed Shaibu, with the argument that he had not duly served the motion before the arraignment of his client.
The Chief Magistrate subsequently granted the motion supported by eight paragraphs and adjourned the case to December 3.
